What is a Driving Without Insurance Ticket?
In Ontario, it’s illegal to operate, or allow someone else to operate, a vehicle without valid insurance. Both the driver and the vehicle owner can be given driving without insurance tickets if coverage isn’t in place.
If a driver has previously been convicted and has been denied insurance, or they have opted not to buy any, it can become a serious issue if they are stopped by the police. The best option for any driver is to simply never be in a situation where they don’t have coverage.
No Proof of Insurance at the Roadside
Not every charge means you were driving uninsured. Some drivers receive tickets for failing to show proof at the roadside. If your insurance was valid but you didn’t have access to the slip or digital copy, it’s worth challenging. We can help you understand how to fight a no proof of insurance ticket based on the facts of your case.
What Are the Penalties for a No Insurance Ticket?
A no insurance ticket carries some of the harshest fines in Ontario traffic law. Even a first offence can result in a minimum $5,000 fine, which rises to over $6,000 after mandatory court costs. For a second offence, the fine doubles and can reach more than $12,000, along with the possibility of a licence suspension of up to one year.
These charges also have long-term consequences. A conviction will stay on your driving record for three years and can significantly affect your insurance rates, sometimes making it difficult to get coverage at all.
No Insurance – section 2.1 under Compulsory Automobile Insurance Act
The Compulsory Automobile Insurance Act (CAIA) states that “ No owner or lessee of a motor vehicle shall:
- a) Operate a motor vehicle unless insured with valid insurance
- b) Permit the motor vehicle to be operated unless it is insured with valid insurance
- Operating a motor vehicle without insurance is a serious offence, and if found guilty, the penalties are a minimum $5000 set fine totalling $6250 with court costs.
- A second conviction doubles the fines to $10,000, $12,500 with court costs, and the possibility of a licence suspension of up to one year, along with the fine.
- All convictions will stay on your driving record for 3 years and could affect your insurance rating.
The cost of insurance may be high, but the cost of being convicted without insurance is much higher.
